INTRODUCTION: THE MADKHALI DECEPTION EXPOSED

The Madkhali defense of Saudi Arabia’s UN membership is built on a fundamental lie: that Saudi Arabia “accepted what aligns with Shari’ah and rejected what contradicts it” regarding the UN.

The truth is, Saudi Arabia accepted the entire UN Charter (all 111 Articles) without any reservations whatsoever. This is a legal requirement for UN membership. What they rejected were optional treaties that came AFTER membership, but the Charter itself, which establishes legislative and judicial authority beyond Allah, was accepted completely.

Important: We do not intend to make takfīr of anyone. Nowhere in the article do we state that this is kufr akbar, nor do we claim that Saudi Arabia, or anyone else, is a kāfir. That discussion is irrelevant here. Accepting the authority of the United Nations is a disgrace and a betrayal of the Ummah and of Islam. That point alone is sufficient to make our position clear.

PART 1: LINE-BY-LINE REFUTATION OF THE MADKHALI LIES

MADKHALI CLAIM #1:

“WHEN MBS SAYS SAUDI ARABIA IS ONE OF THE COUNTRIES THAT CO-FOUNDED THE UNITED NATIONS, HE MEANS THAT SAUDI ARABIA WAS AMONG THE FIRST 50 NATIONS TO JOIN THE UN AT ITS FOUNDING—NOT THAT THEY CREATED ITS LAWS OR WHATEVER.”

REFUTATION:

This is irrelevant misdirection. No one claims Saudi Arabia “created” UN laws. The issue is that Saudi Arabia ACCEPTED UN laws by signing the Charter.

October 24, 1945: Saudi Arabia signed the UN Charter and became a founding member

Legal requirement: ALL signatories accept ALL 111 Articles of the Charter, no exceptions, no reservations

By signing, Saudi Arabia accepted:

Article 2(6): Non-members shall act in accordance with UN principles

The Organization shall ensure that states which are not Members of the United Nations act in accordance with these Principles so far as may be necessary for the maintenance of international peace and security.

Article 24: Security Council has “primary responsibility” for peace/security

In order to ensure prompt and effective action by the United Nations, its Members confer on the Security Council primary responsibility for the maintenance of international peace and security, and agree that in carrying out its duties under this responsibility the Security Council acts on their behalf. In discharging these duties the Security Council shall act in accordance with the Purposes and Principles of the United Nations. The specific powers granted to the Security Council for the discharge of these duties are laid down in Chapters VI, VII, VIII, and XII. The Security Council shall submit annual and, when necessary, special reports to the General Assembly for its consideration.

Article 25: “Members agree to accept and carry out the decisions of the Security Council” ← THIS IS BINDING LEGISLATION

The Members of the United Nations agree to accept and carry out the decisions of the Security Council in accordance with the present Charter.

Articles 92-96: International Court of Justice as “principal judicial organ”

The International Court of Justice shall be the principal judicial organ of the United Nations. It shall function in accordance with the annexed Statute, which is based upon the Statute of the Permanent Court of International Justice and forms an integral part of the present Charter.

Saudi Arabia accepted a legislative authority (Security Council) and judicial authority (ICJ) beyond Allah’s Shari’ah.

MADKHALI CLAIM #2:

“THESE LAWS DO NOT APPLY TO SAUDI ARABIA SINCE THEY GO AGAINST THE SHARI’AH.”

REFUTATION:

This is a blatant lie. The UN Charter explicitly states that it DOES apply to Saudi Arabia.

PROOF FROM THE UN CHARTER:

Article 2(5): All Members shall give the United Nations every assistance in any action it takes in accordance with the present Charter, and shall refrain from giving assistance to any state against which the United Nations is taking preventive or enforcement action.

Article 2(6): “The Organization shall ensure that states which are not Members of the United Nations act in accordance with these Principles so far as may be necessary for the maintenance of international peace and security.”

Article 25: “The Members of the United Nations agree to accept and carry out the decisions of the Security Council in accordance with the present Charter.”

Article 103: “In the event of a conflict between the obligations of the Members of the United Nations under the present Charter and their obligations under any other international agreement, their obligations under the present Charter shall prevail.”

When Saudi Arabia says “these laws don’t apply to us,” they are violating their Charter obligations, but they cannot claim they never accepted them. By remaining a UN member, they continue to accept the Charter’s authority.

Allah said:

But no! By your Lord, they will never be ˹true˺ believers until they accept you ˹O Prophet˺ as the judge in their disputes, and find no resistance within themselves against your decision and submit wholeheartedly.

By accepting the Security Council’s binding authority and the ICJ’s judicial authority, Saudi Arabia has made other than Allah and His Messenger judges in their affairs.

MADKHALI CLAIM #3:

“WHEN THE (UN) SYSTEMS WERE PRESENTED TO KING ABDUL AZIZ. IT WAS SAID THAT HE STUDIED THEM AND DIVIDED THEM INTO TWO SECTIONS: THE FIRST SECTION: WHAT CONTRADICTED THE SHARI’AH, AND HE REJECTED AND REFUSED IT. THE SECOND SECTION: WHAT DID NOT CONTRADICT THE SHARI’AH, AND HE APPROVED IT.”

REFUTATION:

This is either:

  1. A fabrication with no authentic historical documentation, OR
  2. It refers to optional UN treaties that came AFTER membership, NOT the Charter itself

LEGAL IMPOSSIBILITY:

The Vienna Convention on the Law of Treaties (1969) and established international law make it legally impossible to accept only “parts” of a founding charter.

When the UN Charter was drafted at the San Francisco Conference (April-June 1945):

  • Required acceptance of the ENTIRE Charter for ratification
  • Unlike treaties, the Charter does not allow reservations
  • Countries either accept the full Charter or don’t join

If King Abdul-Aziz truly “rejected” parts of the Charter, then Saudi Arabia would not have been admitted as a member. The fact that Saudi Arabia was admitted proves they accepted the entire Charter.

MADKHALI CLAIM #4:

“BECAUSE EVERYONE RULES IN HIS COUNTRY ACCORDING TO THE SYSTEM THAT IS WITH HIM. SO THE AHL AL ISLĀM SEEK JUDGMENT FROM THE BOOK AND THE SUNNAH, AND OTHERS FROM THEIR (MAN MADE) LAWS. AND THE UNITED NATIONS DOES NOT FORCE/ASK ANYONE TO RULE BY OTHER THAN WHAT HE RULES BY IN HIS COUNTRY.”

REFUTATION:

This claim conflates domestic law with international obligations and structural acceptance of authority.

THE ISLAMIC ISSUE IS NOT WHETHER THE UN “FORCES” SAUDI TO CHANGE DOMESTIC LAW. The issue is that Saudi Arabia has accepted in principle that:

  1. The Security Council has binding legislative authority over them
  2. The ICJ has judicial authority they recognize
  3. “International law” is a legitimate legal framework
  4. Charter obligations supersede even Islamic commitments if they conflict

EXAMPLES OF UN SECURITY COUNCIL RESOLUTIONS THAT SAUDI ACCEPTED AS BINDING:

Resolution 242 (1967): Established framework for Israeli-Palestinian conflict, based on “international law,” not Shari’ah

Resolution 660 (1990): Demanded Iraq withdraw from Kuwait—Saudi accepted this authority over a Muslim-Muslim conflict

Resolution 1267 (1999): Established sanctions against Taliban/Al-Qaeda—forced Saudi to freeze assets of Muslims without Shari’ah trial

Resolution 1373 (2001): Required all states to prevent “terrorism” (defined by UN, not Shari’ah), Saudi implemented this

Resolution 1540 (2004): Binding obligation on WMD non-proliferation, overrides Saudi sovereignty

By accepting Article 25, Saudi Arabia agreed that Security Council decisions are binding on them—even when those decisions:

  • Are based on man-made “international law”
  • Concern conflicts between Muslims
  • Define crimes (like “terrorism”) according to non-Islamic criteria
  • Override Saudi’s own assessment of Islamic interests

ALLAH SAYS:

Indeed, We revealed the Torah, containing guidance and light, by which the prophets, who submitted themselves to Allah, made judgments for Jews. So too did the rabbis and scholars judge according to Allah’s Book, with which they were entrusted and of which they were made keepers. So do not fear the people; fear Me! Nor trade my revelations for a fleeting gain. And those who do not judge by what Allah has revealed are ˹truly˺ the disbelievers.

Is it the judgment of ˹pre-Islamic˺ ignorance they seek? Who could be a better judge than Allah for people of sure faith?

MADKHALI CLAIM #5:

“AND JOINING IT IS NOTHING BUT FROM THE TREATIES THAT TAKE PLACE BETWEEN THE MUSLIMS AND THE KUFFĀR.”

REFUTATION:

This is a false equivalence. UN membership is structurally different from Islamic treaties with non-Muslims.

ISLAMIC TREATIES (MU’AHADAH) – PERMISSIBLE:

Examples: Treaty of Hudaybiyyah, pacts with Jewish tribes in Medina, peace agreements

Characteristics:

  • Establish specific cooperation (peace, trade, prisoners)
  • Temporary or conditional
  • Do NOT accept kuffar legal/judicial authority
  • Do NOT recognize kuffar courts as legitimate
  • Remain within Islamic sovereignty
  • Can be broken if other party violates terms

UN CHARTER MEMBERSHIP – FUNDAMENTALLY DIFFERENT:

Characteristics:

  • Accepts ongoing binding authority (Security Council)
  • Recognizes international courts as legitimate (ICJ)
  • Submits to “international law” framework
  • Makes Charter obligations supreme over other agreements (Article 103)
  • Permanent commitment (difficult to leave)
  • Accepts a constitutional-level authority structure

THE KEY DIFFERENCE:

The Treaty of Hudaybiyyah said: “If anyone from Muhammad comes to Quraysh, they will return him; if anyone from Quraysh goes to Muhammad, he will not return them.”

This was a specific agreement on a specific issue.

The treaty DID NOT say: “The Muslims accept that Quraysh courts have binding judicial authority” or “Muslims agree to implement Quraysh laws” or “Quraysh rulings shall prevail over Islamic rulings.”

But the UN Charter DOES say these things:

  • Article 25: Members “accept and carry out” Security Council decisions
  • Article 92: ICJ is the “principal judicial organ”
  • Article 103: Charter obligations “shall prevail”

Allah says:

Never will the Jews or Christians be pleased with you, until you follow their faith. Say, “Allah’s guidance is the only ˹true˺ guidance.” And if you were to follow their desires after ˹all˺ the knowledge that has come to you, there would be none to protect or help you against Allah.

The UN system is their millah (religion/way) of governance, based on secular humanism, not revelation.

MADKHALI CLAIM #6:

“WHEN MBS SAYS ‘THE RULE OF LAWS THAT GOVERNS THE WORLD,’ IT IS IMPORTANT TO UNDERSTAND WHAT HE MEANS BY ‘LAWS,’ SINCE THERE ARE TWO TYPES. LAW (NIDHĀM) IS OF TWO TYPES: IDĀRĪ (ORGANISATIONAL, ADMINISTRATIVE, REGULATORY) AND SHAR’IYY (LEGISLATIVE, PERTAINING TO THE SHARI’AH).”

REFUTATION:

This distinction is valid in principle but is being misapplied to defend the indefensible.

YES, ADMINISTRATIVE REGULATIONS (NIDHAM IDARI) ARE PERMISSIBLE:

Examples:

  • Traffic laws (drive on right vs. left)
  • Building codes
  • Postal systems
  • Passport requirements
  • Public health regulations

Conditions:

  • They serve legitimate public interest (maslahah)
  • They don’t contradict Shari’ah
  • They remain within the framework of Islamic sovereignty
  • They are not treated as equal to Shari’ah

BUT THE UN CHARTER IS NOT “ADMINISTRATIVE”, IT IS CONSTITUTIONAL:

The UN Charter establishes:

1. LEGISLATIVE AUTHORITY:

  • Article 25: Security Council makes binding laws
  • These are not “traffic regulations”, they are substantive legal obligations
  • Example: Resolution 1373 (2001) created new legal obligations for all states on counter-terrorism

2. JUDICIAL AUTHORITY:

  • Articles 92-96: ICJ judges disputes according to:
    • International law
    • International conventions
    • “General principles of law recognized by civilized nations”
    • NOT according to Shari’ah

3. CONSTITUTIONAL SUPREMACY:

  • Article 103: Charter obligations prevail over all other agreements
  • This is not “administrative”, this is a supremacy clause like in national constitutions

4. SOVEREIGNTY TRANSFER:

  • Article 2(7): UN can intervene in domestic jurisdiction for Chapter VII matters
  • Article 39: Security Council determines what constitutes “threat to peace”
  • Article 42: Security Council can authorize military action

THESE ARE NOT TRAFFIC LAWS.

ALLAH SAYS:

Whatever ˹idols˺ you worship instead of Him are mere names which you and your forefathers have made up—a practice Allah has never authorized. It is only Allah Who decides. He has commanded that you worship none but Him. That is the upright faith, but most people do not know.

The word “الْحُكْمُ” (al-hukm) encompasses all forms of authority and judgment, not just ritual worship. By accepting the UN Charter’s legislative and judicial authority, Saudi has violated this principle.

MADKHALI CLAIM #7:

“AL-JUBEIR AT THE UNITED NATIONS: ‘AND IN THE EVENT THAT THESE TERMS GO BEYOND THEIR INTENDED MEANINGS, MY COUNTRY AFFIRMS ITS FULL SOVEREIGN RIGHT TO RESERVE THE IMPLEMENTATION OF ANY RECOMMENDATIONS THAT CONFLICT WITH THE PRINCIPLES OF OUR ISLAMIC RELIGION AND OUR LEGISLATION.’”

REFUTATION:

Notice the key word: “RECOMMENDATIONS”

This statement refers to:

  • General Assembly resolutions (non-binding)
  • UN agency recommendations
  • Optional treaty provisions

This statement DOES NOT apply to:

  • UN Charter obligations (binding)
  • Security Council resolutions under Chapter VII (binding)
  • ICJ rulings if Saudi accepts jurisdiction (binding)

THE DECEPTION:

The Madkhalis point to Saudi “reserving the right” regarding non-binding recommendations and pretend this applies to binding Charter obligations. IT DOES NOT.

UN Charter Article 25: “The Members of the United Nations agree to accept and carry out the decisions of the Security Council in accordance with the present Charter.”

This is mandatory, not a “recommendation.” Saudi cannot reserve the right to reject these, by remaining a UN member, they’ve accepted Article 25.

EXAMPLES OF SAUDI COMPLYING WITH BINDING UN DECISIONS:

1. Resolution 660 (1990) – Iraq-Kuwait: Saudi immediately complied with Security Council demands, even hosting foreign troops

2. Resolution 1373 (2001) – Counter-Terrorism: Saudi implemented extensive anti-terrorism laws based on UN definitions, including:

  • Freezing assets of individuals designated by UN (not Shari’ah courts)
  • Criminalizing “terrorism” as defined by UN (not Islamic criteria)
  • Sharing intelligence with non-Muslim countries

3. Resolution 1540 (2004) – WMD Non-Proliferation: Saudi fully complied with reporting requirements and restrictions

4. Various sanctions regimes: Saudi has enforced UN sanctions against:

  • Libya (1990s)
  • Sudan (1990s)
  • Iraq (1990-2003)
  • North Korea (ongoing)
  • Iran (various periods)

Saudi does implement binding UN decisions, proving they’ve accepted the Charter’s authority. Their “reservation of rights” applies only to non-binding matters.

MADKHALI CLAIM #8:

“SAUDI ARABIA HAS NEVER AGREED TO ARTICLE 16 OF THE ‘HUMAN RIGHTS’ DECLARATION… SIMILARLY, THE KSA HAS NEVER AGREED TO ARTICLE 18… THE KINGDOM DID NOT ACCEDE TO TWO INTERNATIONAL TREATIES: CONCERNING ECONOMIC, SOCIAL, AND CULTURAL RIGHTS, AND CONCERNING POLITICAL AND CIVIL RIGHTS.”

REFUTATION:

This is irrelevant to the core issue. All of these are optional treaties, not the mandatory Charter.

UNDERSTANDING THE UN STRUCTURE:

TIER 1: UN CHARTER (Mandatory for membership)

  • 111 Articles
  • MUST be accepted in full
  • NO reservations allowed
  • Contains binding obligations (Articles 25, 103, etc.)
  • SAUDI ACCEPTED THIS FULLY IN 1945

TIER 2: Optional Treaties & Conventions

  • Universal Declaration of Human Rights (UDHR) – non-binding declaration
  • ICCPR, ICESCR – optional treaties
  • CEDAW, CRC, CAT – optional treaties
  • Countries can refuse to ratify
  • Countries can add reservations if they do ratify
  • SAUDI REFUSED MANY OF THESE (THIS IS GOOD)

THE MADKHALI DECEPTION:

They point to TIER 2 refusals and pretend Saudi also refused TIER 1.

THIS IS A LIE.:

Imagine a club with:

  • Mandatory Constitution: All members must accept (like UN Charter)
  • Optional Activities: Members can skip if they want (like UN treaties)

The Madkhalis say: “Saudi joined the club but skips some optional activities, therefore they didn’t accept the mandatory constitution.” THIS IS ABSURD.

By remaining a club member, you’ve accepted the constitution, regardless of which optional activities you participate in.

PART 2: THE BINDING NATURE OF UN CHARTER ARTICLES

A. ARTICLES ESTABLISHING LEGISLATIVE AUTHORITY

ARTICLE 24 – Security Council Primary Responsibility:

“In order to ensure prompt and effective action by the United Nations, its Members confer on the Security Council primary responsibility for the maintenance of international peace and security, and agree that in carrying out its duties under this responsibility the Security Council acts on their behalf.”

Saudi has “conferred” (given) the Security Council authority to act “on their behalf.”

ARTICLE 25 – Binding Decisions:

“The Members of the United Nations agree to accept and carry out the decisions of the Security Council in accordance with the present Charter.”

Key words:

  • “Agree” = voluntary acceptance
  • “Accept” = acknowledge authority
  • “Carry out” = implement/execute

This is explicit acceptance of legislative authority beyond Allah’s Shari’ah.

ARTICLE 39 – Determination Authority:

“The Security Council shall determine the existence of any threat to the peace, breach of the peace, or act of aggression and shall make recommendations, or decide what measures shall be taken…”

Saudi has accepted that the Security Council (dominated by non-Muslim powers) has authority to determine what constitutes threats to peace—even concerning Muslim affairs.

ARTICLE 41 – Non-Military Measures:

“The Security Council may decide what measures not involving the use of armed force are to be employed… These may include complete or partial interruption of economic relations… and the severance of diplomatic relations.”

Saudi has accepted that the Security Council can force them to:

  • Cut economic ties with other countries (even Muslim countries)
  • Sever diplomatic relations
  • İmplement sanctions

ARTICLE 42 – Military Measures:

“Should the Security Council consider that measures provided for in Article 41 would be inadequate… it may take such action by air, sea, or land forces as may be necessary to maintain or restore international peace and security.”

Saudi has accepted that the Security Council can authorize military action, and Saudi must support it (Article 2(5)).

B. ARTICLES ESTABLISHING JUDICIAL AUTHORITY

ARTICLE 92 – ICJ Establishment:

“The International Court of Justice shall be the principal judicial organ of the United Nations. It shall function in accordance with the annexed Statute…”

Saudi has recognized a court that judges by other than Shari’ah as a “principal judicial organ.”

ARTICLE 93 – Automatic ICJ Membership:

“All Members of the United Nations are ipso facto parties to the Statute of the International Court of Justice.”

By joining the UN, Saudi automatically became a party to the ICJ Statute.

ARTICLE 94 – Compliance with ICJ Rulings:

“Each Member of the United Nations undertakes to comply with the decision of the International Court of Justice in any case to which it is a party.”

If Saudi accepts ICJ jurisdiction in a case, they’ve committed to obeying its ruling, even if it contradicts Islamic law.

ARTICLE 96 – Advisory Opinions:

“The General Assembly or the Security Council may request the International Court of Justice to give an advisory opinion on any legal question.”

Saudi has accepted that the ICJ’s “advisory opinions” on “legal questions” have authority, even though these are based on “international law,” not Shari’ah.

ICJ STATUTE ARTICLE 38 – Sources of Law:

“The Court… shall apply: a. international conventions b. international custom c. the general principles of law recognized by civilized nations d. judicial decisions and teachings of publicists”

Saudi has accepted a court that applies:

  • Man-made conventions
  • Man-made customs
  • Principles from “civilized nations” (i.e., Western nations)
  • NOT the Qur’an and Sunnah

C. ARTICLE 103 – SUPREMACY CLAUSE (THE MOST DEVASTATING)

ARTICLE 103:

“In the event of a conflict between the obligations of the Members of the United Nations under the present Charter and their obligations under any other international agreement, the obligations under the present Charter shall prevail.”

WHAT THIS MEANS:

If there is a conflict between:

  • ❌ Saudi’s Islamic commitments (treaties with Muslim countries, Islamic solidarity, etc.)
  • ✅ UN Charter obligations

The Charter PREVAILS.

EXAMPLE:

  • Saudi has Islamic brotherhood obligations to support Muslim countries
    • Security Council passes Resolution sanctioning a Muslim country (e.g., Sudan, Iraq, Afghanistan)
      • Article 103 + Article 25 = Saudi must implement UN sanctions, even if it contradicts Islamic interests

This makes the UN Charter supreme over Islamic obligations audubillah.

PART 3: PROOF THAT UN MEMBERSHIP REQUIRES ACCEPTING ALL CHARTER ARTICLES

A. FROM THE UN CHARTER ITSELF

CHAPTER II – MEMBERSHIP

Article 4(1):

“Membership in the United Nations is open to all other peace-loving states which accept the obligations contained in the present Charter and, in the judgment of the Organization, are able and willing to carry out these obligations.”

Key phrase: “accept the obligations contained in the present Charter”

This means: You must accept ALL obligations, not pick and choose.

Article 4(2):

“The admission of any such state to membership in the United Nations will be effected by a decision of the General Assembly upon the recommendation of the Security Council.”

What this proves: Admission is conditional on accepting the Charter. If Saudi “rejected” parts as the Madkhalis claim, they wouldn’t have been admitted.

Article 110 – Entry into Force:

“The present Charter shall come into force upon the deposit of ratifications by… all signatories…”

What this proves: Ratification means accepting the entire Charter. You can’t “ratify” only parts of a charter.

B. FROM INTERNATIONAL LAW PRINCIPLES

Vienna Convention on the Law of Treaties (1969) – Article 2(1)(d):

“‘reservation’ means a unilateral statement… made by a State, when signing, ratifying, accepting, approving or acceding to a treaty, whereby it purports to exclude or to modify the legal effect of certain provisions of the treaty…”

Article 19 – Formulation of Reservations:

“A State may, when signing, ratifying… formulate a reservation unless: (a) the reservation is prohibited by the treaty; (b) the treaty provides that only specified reservations… may be made; (c) … the reservation is incompatible with the object and purpose of the treaty.”

APPLICATION TO UN CHARTER:

The UN Charter does not contain a reservations clause. Unlike optional treaties (ICCPR, CEDAW, etc.) which explicitly allow reservations, the Charter is silent.

Reservations to the UN Charter are not permitted because:

  1. It’s a constitutional document
  2. It would undermine the organization’s universality
  3. Articles 4 and 110 require complete acceptance

PART 4: MORE UN ARTICLES THAT CONSTITUTE KUFR

SOVEREIGNTY VIOLATIONS

Article 2(7) – Domestic Jurisdiction:

“Nothing contained in the present Charter shall authorize the United Nations to intervene in matters which are essentially within the domestic jurisdiction of any state… but this principle shall not prejudice the application of enforcement measures under Chapter VII.”

This means the UN can intervene in “domestic” matters if the Security Council declares it a Chapter VII issue.

Examples of UN intervention in Muslim countries’ “domestic” affairs:

  • Libya (2011) – Security Council authorized NATO intervention
  • Somalia (1990s) – UN intervention in civil war
  • Bosnia (1990s) – UN intervention in internal conflict
  • Iraq (1990-2003, 2003-present) – Comprehensive intervention

Muslim rulers have authority over their territories based on Shari’ah. The UN Charter overrides this by giving the Security Council intervention authority.

Article 39 – Determination of Threats:

“The Security Council shall determine the existence of any threat to the peace, breach of the peace, or act of aggression…”

The Security Council (5 permanent members: USA, UK, France, Russia, China + 10 rotating members) determines what constitutes:

  • “Threat to peace”
  • “Breach of peace”
  • “Act of aggression”

This means: When the Security Council declared Iraq’s invasion of Kuwait (1990) an “act of aggression,” Saudi had to accept this determination, even though it was a Muslim-Muslim conflict that should be resolved by Islamic principles.

Article 43 – Military Agreements:

“All Members of the United Nations… undertake to make available to the Security Council, on its call… armed forces, assistance, and facilities…”

Saudi has agreed in principle to provide military forces to the Security Council upon demand.

This means: If the Security Council demanded Saudi troops for a UN operation against a Muslim country, Saudi would be obligated under Article 43 to comply.

Article 48 – Carrying Out Decisions:

“The action required to carry out the decisions of the Security Council… shall be taken by all the Members of the United Nations or by some of them, as the Security Council may determine.”

Saudi must carry out Security Council decisions, even if those decisions harm Muslim interests.

ECONOMIC AUTHORITY

Article 41 – Economic Sanctions:

“The Security Council may decide what measures not involving the use of armed force are to be employed… These may include complete or partial interruption of economic relations…”

SAUDI COMPLIANCE EXAMPLES:

1. Iraq Sanctions (1990-2003):

  • Comprehensive economic embargo
  • Caused massive civilian suffering
  • Conservative estimates: 500,000+ Iraqi civilians died due to sanctions
  • Saudi fully implemented these sanctions, including:
    • Cutting all trade
    • Freezing Iraqi assets
    • Preventing Iraq from selling oil

Saudi participated in economically strangling a Muslim country for 13 years, causing mass death, based on UN authority.

2. Iran Sanctions (Various periods):

  • Restrictions on oil sales
  • Financial sanctions
  • Asset freezes
  • Saudi implemented UN sanctions against fellow Muslims

3. Libya Sanctions (2011):

  • Asset freezes on Gaddafi regime
  • Arms embargo
  • Saudi enforced these against a Muslim country

IDEOLOGICAL FOUNDATIONS OF THE UN

UN Charter Preamble:

“WE THE PEOPLES OF THE UNITED NATIONS DETERMINED

  • to save succeeding generations from the scourge of war…
  • to reaffirm faith in fundamental human rights…
  • to establish conditions under which justice and respect for… international law can be maintained…”

The Charter’s ideological foundation is:

  • “Human rights” (secular humanist concept, not Islamic rights)
  • “International law” (man-made law, not Shari’ah)
  • “Peoples” deciding their fate (popular sovereignty, not Allah’s sovereignty)

This is the creed of humanism, not Islam.

Article 1 – Purposes:

“The Purposes of the United Nations are:

To maintain international peace and security… and to bring about by peaceful means… settlement of international disputes… in conformity with the principles of justice and international law…”

“Justice” is defined by “international law”, not Shari’ah.

What is “international law”?

  • Man-made principles developed primarily by Western powers
  • Based on:
    • Treaty law (agreements between states)
    • Customary international law (practices accepted as legal)
    • “General principles of law recognized by civilized nations” (i.e., Western legal principles)
    • NOT divine revelation

By accepting Article 1, Saudi has accepted that “international law” is a legitimate source of justice.

THE IMPORTANT DISTINCTION:

We are NOT declaring takfir on:

  • Individual Saudi citizens
  • Individual Saudi scholars who are forced to remain silent
  • Muslims who are ignorant of this reality

We ARE declaring:

  • The act of joining the UN and accepting its Charter is kufr
  • Saudi Arabia’s government has committed this kufr
  • Muslims must recognize this reality and work to change it

The conditions of takfir (making someone a kafir) include:

  1. Knowledge (عِلم)
  2. Intention (قَصد)
  3. Ability (قُدرة)
  4. Absence of compulsion (عَدم الإكراه)

Only Allah knows who meets these conditions regarding individuals.

But the ruling on the act itself is clear: Accepting man-made legislative and judicial authority beyond Allah’s Shari’ah is كفر (when accepted as the legitimate source)

FINAL CONCLUSION: THE ONLY SOLUTION: ISLAMIC UNITY UNDER ONE BANNER

THE CRISIS WE FACE

The evidence presented reveals a devastating reality: the Muslim Ummah has been fractured into 50+ nation-states, each bound by the UN Charter, a system that fundamentally contradicts Allah’s Shari’ah.

When the Ummah abandoned:

  • One Khalifah → We got 50+ presidents and kings
  • One Shari’ah → We got “international law”
  • One Banner (لا إله إلا الله) → We got national flags
  • Islamic brotherhood → We got artificial borders

Allah warned us:

And hold firmly together to the rope of Allah1 and do not be divided. Remember Allah’s favour upon you when you were enemies, then He united your hearts, so you—by His grace—became brothers. And you were at the brink of a fiery pit and He saved you from it. This is how Allah makes His revelations clear to you, so that you may be ˹rightly˺ guided.

THE ROOT CAUSE: ABOLITION OF THE KHILAFAH

March 3, 1924: The last Islamic Khilafah was abolished.

What followed:

  1. Sykes-Picot (1916): Colonial powers carved up Muslim lands
  2. UN Creation (1945): A secular world order replaced Islamic authority
  3. Division of Ummah: 50+ competing states, each bound by UN Charter obligations

The Prophet ﷺ Said:

“The Imam (Khalifah) is a shield, behind whom you fight and by whom you are protected.”

Without the Khalifah, we have no shield, we fight each other, and we are defenseless.

THE VISION: ONE UMMAH, ONE KHALIFAH, ONE SHARI’AH

Imagine if Muslims were united:

Instead of:

  •  50+ weak nations begging the UN for help
  •  Muslims killing Muslims in border disputes
  •  Each country enforcing UN sanctions against fellow Muslims
  •  Artificial borders preventing free movement
  •  Competing armies, economies, and policies

We would have:

  •  One Islamic state with 1.8+ billion citizens
  •  One army defending all Muslim lands
  •  One economy – the largest in the world
  •  One foreign policy based on Islamic interests
  •  One Shari’ah governing all affairs
  •  No UN authority over Muslim lands

This is not a dream, it is our Islamic obligation and historical reality for 1300 years.

ALLAH’S PROMISE

Allah has promised victory to those who establish His law:

Allah has promised those of you who believe and do good that He will certainly make them successors in the land, as He did with those before them; and will surely establish for them their faith which He has chosen for them; and will indeed change their fear into security—˹provided that˺ they worship Me, associating nothing with Me. But whoever disbelieves after this ˹promise˺, it is they who will be the rebellious.

FINAL WORDS

The UN system is not our salvation, it is our shackle.

True independence, dignity, and power come only through:

  • Submission to Allah alone
  • Unity under Islamic governance
  • Implementation of Shari’ah
  • Brotherhood beyond borders

The path forward is clear:

Then when they have ˹almost˺ reached the end of their waiting period, either retain them honourably or separate from them honourably.1 And call two of your reliable men to witness ˹either way˺—and ˹let the witnesses˺ bear true testimony for ˹the sake of˺ Allah. This is enjoined on whoever has faith in Allah and the Last Day. And whoever is mindful of Allah, He will make a way out for them,

Our way out is not through the UN, it is through returning to Allah’s law and Islamic unity.

A CALL TO ACTION:

  • Rulers: Fear Allah and abandon allegiance to man-made systems
  • Scholars: Speak the truth fearlessly, even under pressure
  • Youth: Learn your religion and prepare for leadership
  • Ummah: Work toward unity, reject division, and make du’a

The Khilafah will return. The Ummah will be united. Allah’s law will prevail. It is not a matter of “if”, only “when.” And the question is: Will you be part of that generation, or will you defend the systems of kufr?

This refutation is presented for the sake of Allah, to clarify the truth and refute falsehood. May Allah guide us all to what pleases Him.

All praise is due to Allah, Lord of the worlds. May Allah unite the Ummah, restore the Khilafah, and grant us the honor of living under His Shari’ah.

W’Allahu Alam
